When available, we have provided information for states that have different requirements for government and workplace mediation. This list may not cover private mediator requirements.

Mediation in Alaska:
Anyone can act as a mediator in Alaska – there are no state standards or licensing requirements. It is up to the parties and judges to decide what kind of training and experience they need in a mediator and to ensure that the mediator they select has the necessary skills.

ADR Mediator Requirements for Maricopa County Superior Court:
Approved 40-hour basic mediation training, an approved 20-hour advanced family mediation training, and meet the requirements of A.R.S. § 25-406 (C), which requires six initial hours of training on domestic violence; six initial hours of child abuse training; and four subsequent hours of training every two years on domestic violence and child abuse.

There are no state certified mediators; however, there are guidelines proposed by the Colorado Bar Association and by the Mediation Association of Colorado. These guidelines include: 40 hour basic mediation training, and a commitment to 10 hours of continuing training and education every year.

Nevada Mediation Qualifications: Part C, Rule 4
Mediators can be attorneys or non-attorneys. Mediators must have the equivalent of at least 5 years experience as a mediator or must be a senior judge or justice. 3 hours of continuing mediation education annually is required to remain on the panel of mediators.

40 hours basic mediation training required. Each mediation program in New Mexico is run locally except for the Children’s Court Mediation Program. Mediators are encouraged to make contact with the court executive officer in their Judicial District to learn the qualifications to mediating in their district and area (civil, domestic relations, etc.).

Mediator Qualifications and Continuing Mediation Education: 40 hours of basic formal mediation training; 10 hours of experience in observing a court qualified mediation conduct mediation, and 10 hours in either conducting mediations or co-mediating; successfully pass an exam on the Code of Ethics for ADR providers; agree to conduct at least 3 pro bono mediations each year; be of good moral character. To remain on the court roster, 6 hours of continuing mediation education are required each year, along with conducting at least 6 mediation sessions or 24 hours of mediation during the previous year, submit an annual report to the Director, and complete a minimum of 3 pro bono mediation sessions each year.

Illinois

Illinois Mediation Requirements:
No state requirements or guidelines for the practice of mediation. The use of ADR in the Illinois court system is decided on a circuit-by-circuit basis. Most circuits have mediation programs which may include civil litigation, probate, domestic relations, and community programs. The qualifications for mediators vary among circuits.

Mediator FAQ:
There is no “certification” of mediators in Missouri. However, some mediation programs have specific education requirements, and it is up to the individual to check with the organization as to these requirements. For a court approval, applicants must have 16 hours of mediation training, with the Missouri Bar determining the number of hours of total formal training required. Connecticut Requirements:
No state requirements or guidelines for the practice of mediation. Each civil clerk’s office and court information desk maintains a public listing of private ADR providers but does not make referrals. Court annexed mediation uses primarily retired judges as mediators. Mediation training is not required; however, the Superior Court publishes a list of Superior Court Senior Judges and Judge Trial Referees who have attended mediation training sessions.

ADR Specialist Qualifications:
The ADR proceedings shall be conducted by any individual meeting one of the following criteria:
Successful completion of 25 hours of training in resolving civil disputes in a course approved by the department or division of the government authority charged with responsibility over adult education in the jurisdiction where that individual resides, or
Admission to the bar of the jurisdiction in which that individual resides, together with a minimum of 5 years experience as a practicing attorney.

NJ Mediator Qualifications:
18 hours of basic mediation training is required.

Continuing Mediation Education:
Participation in 10 hours of continuing education every 12 months shall be required of all Accredited Members in order to maintain their status.

Please note that New York State does not “certify” mediators. Mediators who volunteer for CDRCs (Community Dispute Resolution Centers) or belong to ADR member organizations may be certified to mediate only through the particular CDRC or member organization.
Part 146 Mediation FAQ:
24 hours of basic mediation training, and 16 hours of additional training in specific mediation techniques pertaining to the subject area of the types of cases referred to them.

Superior Court Mediation Coordinators Contacts

Mediator Certification Requirements:
40 hours in a trial court mediation training program, or have completed a 16 hour supplemental trial court mediation training. Non-attorneys may be certified if they have completed a six hour training on North Carolina court organization, legal terminology, civil court procedure, the attorney-client privilege, the unauthorized practice of law and common legal issues arising in superior court cases, provided by a trainer certified by the Commission; 3 letters of reference to the Commission; and completed a minimum of 20 hours of basic mediation training, along with mediating 30 disputes.

West Virginia Mediator Guidelines (WV State Bar):
Be a member in good standing of The West Virginia State Bar; Have completed The West Virginia State Bar’s Basic Mediation Training and Advanced Mediation Training programs; Have submitted an application to The West Virginia State Bar asking to be listed as a mediator for circuit courts, and Pay an annual application fee of $25.00. If the attorney is willing to do voluntary mediations in compliance with Rule 25.04, the annual fee will be waived.
