Compliance with the CAN-SPAM Act

CAN-SPAM   =   Controlling the Assault of Non-Solicited Pornography and Marketing

The CAN-SPAM Act, signed into law on December 16, 2003, establishes the first national standards for the sending of commercial e-mail and requires the Federal Trade Commission (FTC) to enforce its provisions. It also requires the FTC to promulgate rules to shield consumers from unwanted mobile service commercial messages.


The Act permits businesses to send unsolicited commercial e-mail as long as it contains all of the following:

  • An opt-out mechanism
  • A functioning return e-mail address
  • A valid subject line indicating it is an advertisement
  • The legitimate physical address of the mailer.

The email you received from MTI complies with the above as follows:

  • It has an opt-out ("do not call") mechanism
  • It has a valid return e-mail address
  • It has an accurate subject line that is not misleading
  • It contains the legitimate physical address of the sender.
